1. Agreement to these Terms

By downloading, accessing, or using OfflineSMS, you agree to these Terms of Service and any policies referenced in them. If you do not agree, do not use the app.

“OfflineSMS,” “we,” “our,” or “us” refers to the operator of the OfflineSMS application. “You” refers to the person or organization using the app.

2. The OfflineSMS service

OfflineSMS is a messaging application that may provide one-to-one chats, group chats, media sharing, message reactions, replies, delivery and read indicators, status features, notifications, offline drafts, queued delivery, and optional SMS follow-up features.

Some features may require internet access, SMS or carrier services, a supported device, an active account, sufficient OfflineSMS Points, or permissions enabled on your device.

3. Eligibility

You must be legally allowed to use online communication services in your country or region. If you use OfflineSMS on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

OfflineSMS is not intended for children under the age required by applicable law to use online communication services without parental or guardian consent.

4. Accounts and verification

OfflineSMS may require you to create or verify an account using a phone number and a one-time verification code. You agree to provide accurate information and to keep your account secure.

• You are responsible for activity that occurs through your account.
• You must not create accounts using false, unauthorized, or misleading information.
• You must not share verification codes or attempt to access another user’s account.
• We may refuse, suspend, or disable accounts that violate these Terms or applicable law.

5. Privacy

Our Privacy Policy explains how OfflineSMS collects, uses, shares, stores, and protects information. By using OfflineSMS, you also agree that we may process information as described in the Privacy Policy.

6. Messages, groups, and user content

You are responsible for the messages, media, profile information, status updates, group names, group images, reactions, and other content you create, upload, send, receive, or share through OfflineSMS.

You keep ownership of your content. You give OfflineSMS a limited, worldwide, non-exclusive license to process, transmit, store, display, and otherwise use your content only as needed to operate, protect, and improve the service.

You agree not to send, upload, or share content that:

• Is illegal, fraudulent, deceptive, abusive, harassing, threatening, hateful, or discriminatory.
• Exploits, harms, or endangers children.
• Violates privacy, publicity, intellectual property, or other rights of any person or organization.
• Contains malware, phishing attempts, spam, scams, or unauthorized advertising.
• Encourages violence, self-harm, criminal activity, or misuse of the service.
• Violates applicable laws, carrier rules, platform rules, or these Terms.

7. SMS follow-up and OfflineSMS Points

OfflineSMS may provide optional SMS follow-up features that allow eligible users to send SMS reminders or messages using OfflineSMS Points. These features may be available only in supported countries, organizations, accounts, or devices.

You are responsible for ensuring that each recipient may lawfully be contacted by SMS and that your message content complies with applicable laws, carrier rules, anti-spam rules, consent requirements, and these Terms.

• SMS delivery may depend on mobile carriers, relay devices, recipient availability, network conditions, and regional rules.
• OfflineSMS may show estimated points cost, reserved points, available balance, delivery state, or related audit information.
• We may block, limit, or reject SMS activity that appears abusive, unlawful, spam-like, unsafe, or technically harmful.
• SMS messages may not be encrypted end-to-end once they leave OfflineSMS and enter standard carrier SMS networks.

8. Payments, purchases, and points

If OfflineSMS offers paid points, subscriptions, premium features, or other purchases, the price, billing method, refund rules, taxes, and any applicable terms will be shown before purchase or made available through the app store, payment provider, or OfflineSMS dashboard.

OfflineSMS Points are intended only for supported OfflineSMS features. They are not money, bank deposits, stored value accounts, cryptocurrency, securities, or a general-purpose payment method. Unless we state otherwise in writing, points cannot be redeemed for cash, transferred outside the supported service, or used outside OfflineSMS.

If purchases are offered inside the Android app, they may be processed through Google Play’s billing system where required by Google Play policy. If purchases are offered inside the iOS app, they may be processed through Apple’s in-app purchase system where required by Apple policy.

9. Permissions and device access

OfflineSMS may request device permissions, such as notifications, contacts, camera, photos, media, microphone, files, or SMS-related access, only as needed for app features. You can manage permissions from your device settings.

Some app features may not work if required permissions are disabled.

10. Acceptable use

You agree not to:

• Use OfflineSMS for spam, bulk abuse, harassment, fraud, phishing, impersonation, or unauthorized marketing.
• Attempt to access accounts, systems, devices, messages, or data without permission.
• Reverse engineer, disrupt, overload, scrape, crawl, or interfere with the service except where allowed by law.
• Bypass limits, rate controls, security checks, verification, billing rules, or moderation controls.
• Use OfflineSMS to violate laws, platform policies, carrier rules, or third-party rights.
• Upload malware or content designed to damage, intercept, or misuse devices, networks, accounts, or data.

11. Reporting, blocking, and moderation

OfflineSMS may provide tools to block users, leave groups, report users, report messages, or report other content. We may review reports, restrict content, remove content, limit features, suspend accounts, disable accounts, or take other action where appropriate.

We may also use automated and manual systems to detect spam, abuse, security issues, policy violations, and technical misuse.

12. Availability and offline-first features

OfflineSMS is designed to support reliable communication, including offline drafts and queued sync where available. However, offline-first features do not guarantee delivery. Delivery may fail or be delayed because of network issues, device restrictions, account restrictions, server downtime, relay unavailability, carrier limitations, or recipient settings.

We may change, suspend, limit, or discontinue any feature at any time, including for maintenance, security, legal compliance, capacity, or product reasons.

13. Intellectual property

OfflineSMS, including its name, logo, design, software, features, documentation, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not give you ownership of OfflineSMS or permission to use our branding except as allowed by us in writing.

14. Third-party services

OfflineSMS may rely on third-party services, such as app stores, cloud hosting, authentication providers, notification providers, analytics or diagnostics tools, SMS carriers, payment providers, or device operating systems.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.

15. Suspension and termination

We may suspend, limit, or terminate your access to OfflineSMS if we reasonably believe that you violated these Terms, created risk or legal exposure, abused the service, harmed other users, or used the app unlawfully.

You may stop using OfflineSMS at any time. Certain provisions of these Terms will continue after termination where they are intended to survive, including sections about content, payments, intellectual property, disclaimers, liability, indemnity, and disputes.

16. Account deletion

You may request deletion of your OfflineSMS account and associated data through the app where available or through our account deletion page.

Some information may be retained for a limited period where needed for legal, security, fraud prevention, audit, dispute resolution, backup, or legitimate operational reasons.

17. Disclaimers

OfflineSMS is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, and security.

We do not guarantee that messages, SMS follow-ups, notifications, sync, media uploads, or delivery/read indicators will always be accurate, immediate, secure, uninterrupted, or error-free.

18. Limitation of liability

To the fullest extent allowed by law, OfflineSMS and its owners, directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

Where liability cannot be excluded, our total liability will be limited to the amount you paid to OfflineSMS for the service giving rise to the claim during the three months before the claim, or USD 50, whichever is greater, unless applicable law requires a higher amount.

19. Indemnity

You agree to defend, indemnify, and hold harmless OfflineSMS and its owners, directors, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of OfflineSMS, your content, your SMS activity, your violation of these Terms, or your violation of law or third-party rights.

20. Changes to these Terms

We may update these Terms from time to time. If changes are material, we may notify you through the app, website, store listing, or other appropriate means. Your continued use of OfflineSMS after changes become effective means you accept the updated Terms.
